digital portal to be compulsory for financial remedy services

HMCTS states digital portal for financial remedy services “could become compulsory by New Year”

Family Lawyers have been told they may be required to submit financial remedy applications through HM Courts and Tribunals Service’s (HMCTS) digital portal in the New Year.

Isabel Syred, HMCTS manager, said this week during a webinar on financial remedy applications that the portal, which will be accessible next month, will allow practitioners to make applications to vary an order.

Syred also revealed that HMCTS is working towards mandating financial remedies services on MyHMCTS by the end of January.

As of today, all applications can be processed digitally, except for schedule 1 applications, and variation order applications. The system will also allow for hearing bundles to be saved in a new tab to allow for greater ease when managing cases.

The agency announced the portal is only for legal representatives. Unrepresented parties must continue to use the paper process.

A spokesperson said:

“Around 80% of financial remedy applications are already processed digitally and we are improving the system based on user feedback to include notifications for urgent cases and introducing barrister access by the end of the year.”

  1. What is the process for unrepresented people? is this not discrimination of the highest digital order?
