Today’s Family Lawyer Podcast: A Year of Insightful Conversations

As Today’s Family Lawyer Podcast approaches the close of another year, it’s time to reflect on a remarkable journey of compelling conversations, industry insights, and actionable advice. Hosted by David Opie, Managing Director at Today’s Media, the podcast has continued to resonate with its audience, offering diverse perspectives on the family law sector.

With over 40 episodes and more than 3,500 downloads since its launch in October 2022, the podcast remains a valuable resource for professionals.

In October this year, Dan Temple of Cobalt Human Solutions joined the podcast to share strategies for creating high-performing teams within law firms. Drawing from his experience as part of the Royal Air Force Chinook crew, Dan highlighted the importance of trust, accountability, and a clear team vision. He also highlighted avoiding a blame culture by fostering a “just culture” where staff can challenge constructively and the innovative concept of “pre-mortems” to anticipate and address potential pitfalls.

In the same month, Vanda James and Tom Quinn, partners at Birketts LLP, discussed the shifting culture in family law towards alternative dispute resolution (ADR):

  • The rising prominence of private FDRs (Financial Dispute Resolution)
  • Court delays and capacity issues accelerating the move toward ADR
  • Balancing the discretionary elements of current processes with the need for greater certainty. Their insights underscored the benefits of ADR in reducing the emotional and financial toll on families

In September, Kathryn Cassells of Vaitilingam Kay Solicitors delved into the world of nuptial agreements, emphasising their practical value. While not legally binding in England and Wales, agreements are gaining recognition following the Rachmacher v Granatino case. She also spoke about the importance of financial disclosure, independent advice, and flexibility to accommodate changing circumstances. Kathryn debunked the myth that nuptial agreements are solely for the wealthy, highlighting their relevance for a wide range of clients.

In another episode, private domestic abuse advisor Caroline Glass offered a look into her role supporting survivors of domestic abuse:

  • Conducting detailed risk assessments and collaborating with family lawyers to explore legal remedies such as non-molestation orders
  • Addressing the rise of technological abuse, from spyware to tracking devices
  • Educating practitioners on the nuanced tactics of coercive control

For Mental Health Awareness Week in May, industry leaders discussed mental health in the legal profession and spoke about strategies for managing stress and achieving “flow state”. Podcast host David Opie welcomed Rayden Solicitors’ Legal Director Marc Etherington, alongside Michael Culver (Culver Law) and Laura Burkinshaw (Convey Law) to discuss the mental health and wellbeing of those working across family law, private client, and residential conveyancing. The three guests identified some shared, and unique, challenges they face in their own roles, and discuss their own experiences of dealing with their mental health and wellbeing.

Also in May, Partner Natalie Lester from Debenhams Ottaway shed light on the critical yet often overlooked topic of pensions in divorce:

  • Strategies to ensure fair distribution, including pension sharing and attachment orders
  • The potential risks of waiving pension rights during emotionally charged proceedings
