Scheme For Court Refunds Now Open

Scheme For Court Refunds Now Open

In 2018 a review found that certain proceedings had been unintentionally set above costs leading the Government to announce that people who have been paid too much, are now able to apply for a refund.

The refund scheme covers specific fees that the Ministry of Justice has identified as being mischarged, either by the wrong fees being charged or incorrectly applied.

The application can be filled in online and then submitted by either email or by post.

16 fees have been identified as having been unintentionally overcharged across Magistrates’ court fees, insolvency proceedings, civil proceedings and court of protection fees.

3 fees have been identified as having been mischarged across Magistrate’s court fees, civil proceedings and Court of Protection fees.

Further guidance on specific circumstances where applications for refunds apply, can be found here.
