The Law Commission has announced plans to publish a scoping paper in November 2024, analysing the current laws governing financial remedies in divorce cases.
This analysis aims to identify any issues within the existing framework that may necessitate law reform.
The Government has tasked the Law Commission with evaluating the effectiveness and fairness of the current laws in delivering consistent outcomes for divorcing couples. This project will examine financial orders issued by courts in England and Wales, and will also consider relevant laws in other countries for comparative analysis.
The forthcoming scoping report will outline potential options for reform, although it will not include specific recommendations. Instead, the report may serve as a foundation for a comprehensive review that could lead to substantive recommendations for legal changes.
Thus far, the Law Commission has engaged extensively with various stakeholders, including those from other jurisdictions, who have a vested interest in the area of financial remedies on divorce.
